Apex Landfill Settlement
A judge in the Court Of Common Pleas in Jefferson County, Ohio has preliminarily approved a class action settlement in the matter of James T. Sutton vs. Apex Environmental LLC. (Case No.: 20-CV-116)
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $3 million dollars, less costs and attorneys’ fees, for members of the Certified Class who did not previously opt out, which is defined as follows:
All owner/occupants and renters of residential property with a physical, residential structure or any part thereof located within four (4) miles of the landfill’s property boundary located at 11 County Road 78, Amsterdam, Ohio at any time since March 16, 2016.
The Settlement also dictates that certain improvement measures at the landfill totaling $1 million dollars will be implemented over the next three years.
The lawsuit, filed in 2020, alleged that noxious odors from the landfill created a nuisance for neighboring residents.
There are several Court-ordered deadlines that must be followed by members of the class:
Claim Forms must be postmarked on or before October 21, 2023 in order to receive compensation from the Settlement Fund.
Opt Outs and Objections must be postmarked on or before October 6, 2023.
