Dovetail Energy Settlement
A judge in the Court Of Common Pleas in Greene County, Ohio has preliminarily approved a class action settlement in the matter of Luke Borntrager et al. vs. Dovetail Energy, LLC et al. (Case No.: 2020CV0615).
The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $635,000 dollars, less costs and attorneys’ fees, for members of the Settlement Class, which is defined as follows:
All owner/occupants and renters of residential property residing within two (2.0) miles of the facility’s property boundary.
The lawsuit, filed in 2020, alleged that noxious odors from the biodigester created a nuisance for neighboring residents.
There are several Court-ordered deadlines that must be followed by members of the class:
Claim Forms must be postmarked on or before June 10, 2024 in order to receive compensation from the Settlement Fund.
Opt Outs and Objections must be postmarked on or before May 27, 2024.
