Decorative Panels International Settlement

A judge of the United States District Court for the Eastern District of Michigan has preliminarily approved a class action settlement in the matter of Burcar, et al. v. Decorative Panels Int’l, Inc., Case No. 1:22-cv-12054-MFL-PTM.

The Settlement, agreed upon by the parties and preliminarily approved by the Court, calls for a cash fund of $1 million dollars, less costs, attorneys’ fees, and any incentive award to the named Plaintiffs that the Court may allow, for members of the Certified Class who did not previously opt out, which is defined as follows:

All owner-occupants or renters of residential property, at any point in the Class Period (1) whose property is located within one mile of the Defendant’s Facility’s property boundary; or (2) who submitted a “Resident Data Sheet” to Plaintiffs’ Counsel.

The lawsuit, filed on August 31, 2022, alleged that noxious odors from the Decorative Panels International Facility, located at 416 Ford Ave. Alpena, Michigan 49707, created a nuisance for neighboring residents.  

There are several Court-ordered deadlines that must be followed by members of the class:

  • Claim Forms must be postmarked on or before February 26, 2024 in order to receive compensation from the Settlement Fund.  

  • Opt Outs and Objections must be postmarked on or before February 9, 2024
